Terms of Service

These terms cover video testimonial services provided by Mistor Testimonials (“Mistor”, “we”), to you, the client (“you”).
1. Service. We interview the students or customers you introduce and edit their interviews into short video clips. Your order confirmation states the number of students, the deliverables and any add-ons.
2. Price and deposit. Prices are listed on our website or in your order. A $250 deposit starts your project. The deposit is credited to your invoice. It is refunded if you keep no clips.
3. Previews and keepers. We deliver watermarked previews of every clip, in vertical (9:16) format only. You choose which clips to keep. You pay for each student from whom you keep at least one clip. Students from whom you keep no clips are free.
4. Payment and final files. The balance is invoiced after you pick your keepers and is due within 7 days, by card through Stripe. Within 7 days of the invoice being paid, we deliver the clips you kept as clean, unwatermarked files in the formats you choose (vertical 9:16, square 1:1 and horizontal 16:9 are all included), plus the raw interview recordings for the students you paid for. Previews may not be published or used in any way.
5. Delivery. We aim to deliver the full pack of previews within 21 days of kickoff. Kickoff is the day we receive your deposit, brand assets and student list. A student who hasn’t booked an interview by day 7 comes off the 21-day timeline, and their previews are delivered within 7 days of their interview.
6. Late delivery. If we miss the 21-day timeline for reasons within our control, you get 20% off the pack price. Delays caused by students, by you, or by events outside our control don’t count.
7. Revisions. One round of changes per student, requested within 7 days of receiving that student’s previews. Changes carry into the final files. Further changes or new edits are quoted separately.
8. Your responsibilities. You confirm that you have permission to introduce your students to us. You’re responsible for how you use the clips and raw recordings, including any results, income or health claims in advertising, and for following advertising rules such as the FTC Endorsement Guides. Any edits you make yourself must not change the meaning of what the student said.
9. Student releases. Each student signs our release before their clips are delivered. We don’t deliver clips from a student without a signed release.
10. Use and portfolio. Once paid, you may use kept clips and the raw recordings for those students in any media. We show your clips in our portfolio only with your written permission.
11. Raw footage. Raw recordings are delivered only after final payment, and only for students you paid for. We delete our copies 90 days after final delivery, unless we agree otherwise.
12. Cancellation. You can cancel before any interview takes place for a full deposit refund. After interviews start, you pay for students already interviewed whose clips you keep.
13. Liability. Our total liability is limited to the amount you paid us for the project.
14. Law. These terms are governed by the laws of California.
